Even I am also one of the victim of this 498A law....my wife put many false allegation against my family and me....which are false....even I have all the documents to prove that.....such as I have taken money from them to get my new car but I have taken the car on loan which I can supported by my bank statement but I am afraid even of proving those ...because even before proving those I will be jailed....even my 50 years old mother has been arrested. Having a good educational back ground and working with top MNC if I need to face this kind of harassment...its very shameful and a question mark to our law which do not bother to protect people like us.
I think this the time we should stop misusing this law.

Section 498A of the Indian Penal Code (IPC), which defines the offence of matrimonial cruelty, was inserted into the IPC by an amendment in 1983. Offenders are liable for imprisonment as well as a fine under the section and the offence is non bailable, non-compoundable and cognizable on a complaint made to the police officer by the victim or by designated relatives.

The section provides an explanation that elaborates the meaning of cruelty as follows:

a) any wilful conduct which is of a nature as is likely to drive the woman to commit suicide or to cause grave injury or danger to her life, limb, or health (whether physical or mental) of the woman; or

b) harassment of the woman where such harassment is with a view to coercing her or any person related to her to meet any unlawful demand for any property or valuable security or is on account of failure by her or any person related to her to meet such demand.”

But This section/ Article is been miss used by many foxy women... In India we must be aware of the law of 498A framed by our Indian Govt. to provide women a sharp weapon that she can cut your head just in moment.

I will not like to remove this section but some Amendment must be done to this law...Because this Article is saving life & respect of many women in India ....

Some serious amendment is required to this 498A law... so that miss use of this section can be stopped...

To fully Abolish this section is foolishness & if it is abolish than some new law must be implemented on behalf of this section... In my opinion amendment can solve problem..

But if governement remove this law then which law will protect women ?

The biggest problem in Inida is .. We don't have common civil law for every religion and community... some community still follows the custom which actually harms the country and their people they are stick to some idiotic things which has least importance in todays world people should understand every time has its own demand now its an high time & some steps should be taken by govt to change some law of India other wise it will be big resistance in near future for growth of india......

As for Example Divorce in India

In most Western nations, there are approximately 16 distinct reasons for which divorces are granted.

In India, however, only five main reasons are generally accepted as sufficient grounds for divorce. Adultery, Desertion, Cruelty, Impotency & Chronic Disease.

I never mean to say divorce is good but... Male and Female must be treated equally, in India life of women become hell if she take divorce, in UK if male give divorce to female then male have to move from that house giving house to female....

We Indian are been govern by very old law's which should be changed now and Comman law for every people should be made.

People can follow their own religion, they can worship their own god, they can marry to one person as per their custom , but when they are going for divorce... then law of divorce should be comman for all religion & community.

Govt. made law of 498A to protect women but few women are missusing it... If Govt want to remove 498A law then they have to bring new law to protect women.

The only problem with most of Indian is they are morally wrong & we all know if people of country are morally wrong, country will not grow.

Politican are elected by people and people give them vote on basis of religion caste language ... people dont see what that candidate has doen in past or he/she is going to do after winning election .. & politian know this so they are dividing indian on all such things caste religion etc. All Political Party of India is non-secular all are baised and all do politics on baisis of caste religion language etc...

This should not be done.very true. The same law which was introduced for the protection of women is being used by some other for their own benefits or venge their anger..
